Equipment Lease Agreement: Rental Terms and Conditions

Deposit: The deposit is refundable upon return of the equipment in accordance with this Agreement.

1. Any technical issue or malfunction of the rental equipment must be reported to the lessor by the lessee or his/her representative as soon as possible.
2. The lessee is responsible for any damage or loss of the rental equipment and gives the lessor the right to charge the cost of repair, or the whole retail price of the equipment in case of loss.
3. The rental equipment must be used in the proper way by the lessee only. The lessee will not allow the equipment to be used or played with by others, especially children.
4. The rental equipment must be kept in a dry and clean place when not in use.
5. Rental mobility products should not be used in rain, snow, or on icy or slippery surfaces.
6. The lessee is responsible for any injury or damage caused by negligence, misuse, accident, or abuse of the equipment.
7. The lessee authorizes the lessor to charge the on-file credit card for any due rental charge, repair cost of damaged equipment, or the total cost of lost equipment.
8. If the rental equipment is returned after the end date without previous notice, the lessee authorizes the lessor to charge the on-file credit card for each extra day or month.
9. Late Return and Extension Fees. The lessee agrees to return all leased equipment on or before the agreed return date. If the equipment is not returned by the due date and the lessee has not contacted and received approval from the lessor to extend the lease term, the following late fees apply:
   • For equipment with a daily rental rate of $150.00 or less, a late fee of $10.00 per day is charged for each day the equipment remains unreturned after the due date.
   • For equipment with a daily rental rate greater than $150.00, a late fee of $30.00 per day is charged for each day the equipment remains unreturned after the due date.
   Late fees accrue daily until the equipment is returned or a lease extension is approved by the lessor. Payment of late fees does not relieve the lessee of the obligation to return the equipment or pay any other amounts due under this Agreement.
10. Early Return and Non-Refundable Rental Payments. The lessee may return the equipment before the end of the agreed rental period; however, all rental payments are non-refundable and will not be prorated or credited for any unused rental period. Any refundable security deposit will be returned after the equipment is inspected and determined to have been returned on time, in good condition (ordinary wear and tear excepted), and after any unpaid charges, damages, or other amounts owed under this Agreement have been deducted.
